IN THE CIRCUIT COURT OF THE THIRD CIRCUIT STATE OF HAWAII AMENDED NOTICE AND SUMMONS STATE OF HAWAII TO: ARTHUR LUDWIG DAHL WHEREAS, an action has been filed in the above Court by Plaintiff SUSAN SWEARINGEN, Successor Personal Representative for the Estate of Robert Lee Keeney, Deceased., in Civ. No. 3CCV-20-0000190, which seeks to obtain a release of a mortgage from Defendant ARTHUR LUDWIG DAHL, which mortgage is recorded in the Office of the Assistant Registrar as Land Court Document No. 1123758, on or about July 15, 1982, and said mortgage is an encumbrance affecting title to real property and should be released pursuant to Section 506-8, Hawaii Revised Statutes. You are hereby cited to appear before the Presiding Judge of the Circuit Court of the Third Circuit, State of Hawaii on the 8th day of October, 2020, at 8:00 a.m., at Hale Kaulike, 777 Kilauea Avenue, Hilo, Hawaii, or to file an Answer to the Complaint for Release of Mortgage or any other pleadings, and to show cause, if any you have, why the prayer of said action should not be granted and to serve a copy of said Answer on attorneys for Plaintiff, Nakamoto, Okamoto&Yamamoto, 187 Kapiolani Street, Hilo, Hawaii 96720. And unless you appear at said Court at the time and place aforementioned or file an Answer before the time aforesaid, your default will be taken as aforesaid, and a Judgment by Default will be taken against you for the relief demanded in the Complaint filed herein, and you will be forever barred from contesting said action or any decree entered thereon.
