NOTICE OF APPLICATION FOR VARIANCE RECEIVED BY THE DEPARTMENT OF HEALTH STATE OF HAWAII Kalanianaole Avenue Reconstruction Kamehameha Avenue to Kauhane Avenue Island of Hawaii Project No. 19L-01-22M Community Noise Control, Variance Application No. V-1268 Docket No. 22-NR-VN-14 Pursuant to Hawaii Revised Statutes, Chapter 342F-5, subsection (h), the State of Hawaii, Department of Transportation, Highways Division, seeks written comments from interested persons regarding the following Community Noise Variance Application. The State of Hawaii, Department of Transportation, Highways Division, Hawaii District, 50 Makaala Street, Hilo, Hawaii 96720, has applied to the Department of Health for a variance from Hawaii Administrative Rules, Chapter 11-46, Section 11-46-6(a), which states, “General Prohibition. Without a permit or variance issued pursuant to section 11-46-7 or 11-46-8, no person within the State shall operate, from any premises or land owned, rented, leased, occupied, or controlled by that person, any excessive noise source.” The applicant proposes to perform cold planing; roadway resurfacing; reconstruction of weakened pavement areas; adjusting utility manhole frames and covers; and installation of pavement marking and striping. The project is estimated to begin as early as the end of April 2022 with major construction activities expected to be completed by approximately June 2022. HDOT is working with the Hawaii Department of Health (DOH) to obtain a Community Noise Variance to allow work during the following times: Sunday 12:00 a.m. to Monday 7:00 a.m. Monday 6:00 p.m. to Tuesday 7:00 a.m. Tuesday 6:00 p.m. to Wednesday 7:00 a.m. Wednesday 6:00 p.m. to Thursday 7:00 a.m. Thursday 6:00 p.m. to Friday 7:00 a.m. Friday 6:00 p.m. to Saturday 9:00 a.m. Saturday 6:00 p.m. to Sunday 12:00 a.m. The Hawaii Administrative Rules, Chapter 11-46 requires that a Community Noise Variance be requested regarding the noise limits and construction hours. If the comments received by April 24, 2022 warrant it, the Department of Health may hold a public hearing regarding the request for this Community Noise Variance at least thirty (30) days after public notice. The final decision will be made on the basis of the application, related documents, written comments and the public hearing, if any.
