NOTICE OF PUBLIC MEETING – Board of Land and Natural Resources to consider Administrative Enforcement Action against JIM JONES, NOELANI YACHT CHARTERS, LLC, KEVIN S. ALBERT, KIMBERLY LEBLANC ALBERT, and the ALBERT REVOCABLE TRUST for violations of Hawaii Administrative Rules (HAR) 13-95-70 and 13-95-71 (Damage to stony coral and live rock).”

The Department of Land and Natural Resources’ (DLNR) Board of Land and Natural Resources (BLNR) will hold a public meeting on Friday, July 28, 2023 to discuss an Administrative Enforcement Action against JIM JONES, NOELANI YACHT CHARTERS, LLC, KEVIN S. ALBERT, KIMBERLY LEBLANC ALBERT, and the ALBERT REVOCABLE TRUST for violations of Hawaii Administrative Rules (HAR) 13-95-70 and 13-95-71 (Damage to Stony Coral and Live Rock) stemming from the February 20, 2023 Nakoa yacht grounding incident in Honolua Bay, Maui. Meeting agenda will be posted at least six (6) days prior to the date of the meeting. Interested persons are urged to participate in the public hearings to present relevant information and individual opinion for BLNR to consider. There are three ways to participate: online via internet or telephone; in-person; or by written testimony.

HOW TO SUBMIT TESTIMONY

1) Online Testimony – Persons can present live video/oral testimony via internet or telephone at the public meeting. To provide video/oral testimony, send your request to blnr.testimony@hawaii.gov. Include your name and the agenda item on which you would like to testify. Once your request has been received, you will receive an email with the Zoom link. Requests may be made during the meeting. 2) In-person Testimony – Attend live at 1151 Punchbowl St. Room 132 (Kalanimoku Building), Honolulu, Hawai’i. Please arrive at least fifteen (15) minutes prior to the meeting start time in order to add your name to the sign-in sheet.

3) Written testimony. Interested persons can submit written testimony in advance of each meeting that will be distributed to BLNR Members prior to the meeting. Submit written testimony via e-mail to blnr.testimony@hawaii.gov or via postal mail to the Board of Land and Natural Resources at P.O. Box 621, Honolulu, Hawai’i 96809. We request written testimony be submitted no later than 24 hours prior to the scheduled meeting to ensure time for BLNR Member review. Late written testimony will be retained as part of the record and distributed to BLNR Members as soon as practicable, but we cannot ensure they will receive it with sufficient time for review prior to decision-making on the agenda item in question.

Anyone with a hearing impairment who desires to testify, may request assistance of a sign language interpreter. The request will need to be received at least seven days before the meeting is scheduled to start.
