NOTICE OF APPLICATION FOR VARIANCE RECEIVED BY THE DEPARTMENT OF HEALTH STATE OF HAWAII Kawaihae Road Replacement of Waiaka Bridge and Realignment of Approaches Island of Hawaii Federal-Aid Project No. BR-019-1(093) Community Noise Control Variance Application No. V-1453 (Docket No. 25-NR-VN-39) Pursuant to Hawaii Revised Statutes, Chapter 342F-5, subsection (h), the State of Hawaii, Department of Transportation, Highways Division, seeks written comments from interested persons regarding the following Community Noise Variance Application. The State of Hawaii, Department of Transportation, Design Branch, 601 Kamokila Boulevard, Kapolei, Hawaii 96707, has applied to the Department of Health for a variance from Hawaii Administrative Rules, Chapter 11-46, Section 11-46-6(a), which states, “General Prohibition. Without a permit or variance issued pursuant to section 11-46-7 or 11-46-8, no person within the State shall operate, from any premises or land owned, rented, leased, occupied, or controlled by that person, any excessive noise source.” The applicant proposes to perform the concrete pours for the new bridge deck and abutments for the Waiaka Bridge located on Kawaihae Road, Waimea, on the Island of Hawaii. The construction of the bridge piers will require pouring the concrete during night and weekend hours. Work will be at Waiaka Bridge shown in the Location Map. The project is estimated to begin as early as March 2026 with major construction activities expected to be completed by approximately March 2028, and the night work will occur within this timeframe. The construction of the bridge piers will require four concrete pours consisting of up to two consecutive nights per pour. HDOT is working with the Hawaii Department of Health (DOH) to obtain a Community Noise Variance to allow work during the following times: Saturday 6:00 p.m. to Monday 7:00 a.m. Monday 6:00 p.m. to Tuesday 7:00 a.m. Tuesday 6:00 p.m. to Wednesday 7:00 a.m. Wednesday 6:00 p.m. to Thursday 7:00 a.m. Thursday 6:00 p.m. to Friday 7:00 a.m. Friday 6:00 p.m. to Saturday 9:00 a.m. The Hawaii Administrative Rules, Chapter 11-46 requires that a Community Noise Variance be requested regarding the noise limits and construction hours. If the comments received by October 31, 2025 warrant it, the Department of Health may hold a public hearing regarding the request for this Community Noise Variance at least thirty (30) days after public notice. The final decision will be made on the basis of the application, related documents, written comments and the public hearing, if any.
