NOTICE OF APPLICATION FOR VARIANCE RECEIVED BY THE DEPARTMENT OF HEALTH STATE OF HAWAII Hakalau Stream Bridge Rehabilitation Island of Hawaii Federal-Aid Project No. BR-019-2(075) Community Noise Control Variance Application No. V-1508 (Docket No. 26-NR-VN-43) Pursuant to Hawaii Revised Statutes, Chapter 342F-5, subsection (h), the State of Hawaii, Department of Transportation, Highways, seeks written comments from interested persons regarding the following Community Noise Variance Application. The State of Hawaii, Department of Transportation, Highways, Design Branch, has applied to the Department of Health for a variance from Hawaii Administrative Rules, Chapter 11-46, Section 11-46-6(a), which states, “General Prohibition. Without a permit or variance issued pursuant to section 11-46-7 or 11-46-8, no person within the State shall operate, from any premises or land owned, rented, leased, occupied, or controlled by that person, any excessive noise source.” The applicant proposes to perform the construction of the bridge substructure for the Hakalau Bridge, located on Hawaii Belt Road (Route 19) in Hilo, on the Island of Hawaii. The construction will require work during night and weekend hours. See Location Map. The project is estimated to begin as early as August 1, 2027, with major construction activities expected to be completed by approximately July 31, 2030. Night and weekend work will occur intermittently within this timeframe, requiring periodic full closure of the bridge totaling up to 30 days over this three-year period. HDOT is working with the Hawaii Department of Health (DOH) to obtain a Community Noise Variance to allow work during the following times: Saturday 6:00 p.m. to Monday 7:00 a.m. Monday 6:00 p.m. to Tuesday 7:00 a.m. Tuesday 6:00 p.m. to Wednesday 7:00 a.m. Wednesday 6:00 p.m. to Thursday 7:00 a.m. Thursday 6:00 p.m. to Friday 7:00 a.m. Friday 6:00 p.m. to Saturday 9:00 a.m. The Hawaii Administrative Rules, Chapter 11-46 requires that a Community Noise Variance be requested regarding the noise limits and construction hours. If the comments received by November 4, 2026 warrant it, the Department of Health may hold a public hearing regarding the request for this Community Noise Variance at least thirty (30) days after public notice. The final decision will be made on the basis of the application, related documents, written comments and the public hearing, if any.
